Terms of Use

These Terms of Use ("Terms") govern your access to and use of the mobile applications Clepsydris and Burrow (collectively, the "Apps"), provided by Appify ("we", "us", or "our"), located in Warsaw, Poland. By downloading, installing, or using the Apps, you agree to be bound by these Terms. If you do not agree, do not use the Apps.

1. Eligibility

You must be at least 16 years of age to use the Apps. By using the Apps, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

2. Description of the Apps

  • Clepsydris is a board game companion app that helps you track gameplay sessions, record scores and time, manage game collections, and view player statistics. It optionally integrates with BoardGameGeek and offers cloud backup and photo storage through a paid subscription. The photo feature is intended exclusively for storing images related to board game sessions (e.g., game setups, scoreboards, game nights).
  • Burrow is an inventory management app that helps you track supplies, monitor expiration dates, manage stock levels, set reminders, and analyze consumption patterns. It offers premium features through in-app purchase.

3. Accounts & Authentication

Clepsydris

Certain features require signing in via Google Sign-In, Apple Sign-In, or anonymous authentication. You are responsible for maintaining the security of your account credentials and any access codes generated for anonymous sign-in. Do not share your password or access code with anyone.

If you connect your BoardGameGeek account, you authorize the App to access and exchange play data with BoardGameGeek on your behalf.

Burrow

Burrow does not require account creation or authentication. All data is stored locally on your device.

4. Subscriptions & In-App Purchases

Some features in the Apps are available only through in-app purchases or subscriptions.

  • Clepsydris offers lifetime purchases (e.g., Full Stats) and recurring subscriptions (e.g., Into the Clouds for cloud backup and sync, Into the Clouds Photos for cloud photo storage, and Premium for all features).
  • Burrow offers a premium tier that unlocks unlimited items and batches.

Billing & Renewal

Subscriptions are billed automatically at the interval you selected at purchase (monthly, quarterly, or yearly) through the Apple App Store or Google Play Store. Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period.

Cancellation

You may cancel your subscription at any time through your device's App Store or Play Store account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Refund requests are handled by Apple or Google according to their respective refund policies.

Price Changes

We may modify subscription fees at our discretion. Any fee changes will take effect at the start of the next billing period following reasonable notice. Continued use of the subscription after a price change constitutes acceptance of the new fee.

5. Cloud Storage & Data

If you subscribe to Clepsydris cloud features, we provide up to 5 GB of storage for database backups and photos. You acknowledge and agree that:

  • Cloud storage is provided "as is" and "as available."
  • You should always maintain local backups of your data. Do not rely on cloud storage as the sole repository for your content.
  • We are not responsible for any loss, corruption, or unavailability of cloud-stored data, including but not limited to database backups and photos, whether caused by technical failures, service outages, third-party provider issues, or any other reason.
  • If your subscription ends for any reason, we reserve the right to delete your cloud-stored data (photos and backups) after a reasonable grace period.
  • We reserve the right to discontinue, suspend, or modify the cloud storage service (in whole or in part) at any time, with or without prior notice. We will make reasonable efforts to notify you in advance, but we are under no obligation to maintain the service indefinitely.

6. User Conduct

You agree not to:

  • Use the Apps in any way that violates applicable laws or regulations
  • Attempt to reverse-engineer, decompile, or disassemble the Apps
  • Use the Apps to transmit, store, or upload any harmful, offensive, illegal, defamatory, or objectionable content
  • Use the photo storage feature to store images that are unrelated to board gaming, or that contain illegal, obscene, harassing, or otherwise inappropriate content
  • Interfere with or disrupt the integrity or performance of the Apps or their associated services
  • Resell, redistribute, or sublicense access to the Apps or any of their features
  • Upload content that infringes on intellectual property rights or contains malicious code
  • Use the Apps or cloud services to store, distribute, or facilitate the distribution of content that violates any third party's rights, including privacy and intellectual property rights

7. User Content

You retain ownership of all data and content you create within the Apps (game logs, inventory items, photos, etc.). You are solely responsible for your content and any data you choose to upload to cloud services or share with third-party platforms such as BoardGameGeek.

We do not monitor, review, or moderate user-uploaded content, including photos. We assume no responsibility or liability for any content that users store, upload, or transmit through the Apps or cloud services. If we become aware of content that violates these Terms or applicable law, we reserve the right to remove it and/or terminate your account without prior notice.

8. Intellectual Property

The Apps, including their design, code, graphics, icons, and content (excluding user content), are owned by Appify and are protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes in accordance with these Terms.

9. Third-Party Services

The Apps integrate with third-party services including Firebase, RevenueCat, BoardGameGeek, Apple App Store, and Google Play Store. Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

10. Service Availability & Discontinuation

We reserve the right to modify, suspend, or permanently discontinue the Apps or any part of their functionality (including cloud services, sync features, and photo storage) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Apps or services.

We do not guarantee any specific level of uptime, availability, or performance. Scheduled or unscheduled maintenance, updates, or external factors may cause temporary or permanent interruptions.

11. Indemnification

You agree to indemnify, defend, and hold harmless Appify from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Apps or cloud services
  • Content you upload, store, or share through the Apps, including photos
  • Your violation of these Terms
  • Your violation of any applicable law or regulation, or any third party's rights

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, cyberattacks, pandemics, or third-party service provider outages.

13. Disclaimer of Warranties

The Apps are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Apps will be uninterrupted, error-free, or free of harmful components
  • Defects will be corrected within any specific timeframe
  • The results obtained from using the Apps will be accurate or reliable
  • Barcode lookups (Burrow) or BoardGameGeek data (Clepsydris) will be complete or up to date

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Appify be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of, or inability to use, the Apps.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or 100 USD, whichever is greater.

15. Termination

We may suspend or terminate your access to the Apps at any time, with or without cause and with or without notice, if we believe you have violated these Terms. Upon termination:

  • Your license to use the Apps is immediately revoked
  • We may delete your cloud-stored data without further obligation
  • Provisions that by their nature should survive termination (including limitations of liability, disclaimers, and intellectual property) shall remain in effect

You may stop using the Apps at any time. Even after you cease use, you remain responsible for any obligations incurred during your use.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Apps after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
