Photos Backup Pro — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Photos Backup Pro macOS application (the "App"), provided by Appify ("we", "us", or "our"), located in Warsaw, Poland. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

2. Description of the App

Photos Backup Pro is a macOS application that exports your Apple Photos library to disk with smart change detection and incremental updates. It allows you to organize exports by date, preserve Live Photos, and back up albums with flexible folder structures. All processing happens locally on your Mac.

3. Purchases

Photos Backup Pro is available through the Mac App Store. Purchases are processed through Apple's payment system. We do not have access to your payment details. Refund requests are handled by Apple according to their refund policy.

4. User Data

All data processed and created by Photos Backup Pro (settings, fingerprints, exported files) remains locally on your Mac. The App does not transmit any data to our servers or any third party. Your photos and exported files are entirely under your control.

The App reads your Apple Photos library in a read-only manner. It never modifies, deletes, or adds photos to your library.

5. User Conduct

You agree not to:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Resell, redistribute, or sublicense access to the App or any of its features

6. Intellectual Property

The App, including its design, code, graphics, icons, and content, is owned by Appify and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Service Availability & Discontinuation

We reserve the right to modify, suspend, or permanently discontinue the App or any part of its functionality at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

8. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will be uninterrupted, error-free, or free of harmful components
  • Defects will be corrected within any specific timeframe
  • All photo formats or library configurations will be supported
  • Exported files will be identical to the originals, complete, uncorrupted, or readable by any particular software
  • The App will successfully detect, export, or preserve every photo, video, Live Photo, edit, metadata field, or album in your library

9. No Liability for Data Loss — User Responsibility for Backups

You acknowledge and agree that Photos Backup Pro is provided as a convenience tool and is not a guaranteed backup solution. You use the App entirely at your own risk.

To the maximum extent permitted by applicable law, Appify shall not be liable, responsible, or accountable in any way for any loss, corruption, deletion, alteration, inaccessibility, or damage to your photos, videos, library, metadata, exported files, or any other data, whether such loss or damage results from:

  • Bugs, errors, defects, malfunctions, crashes, hangs, or unexpected behavior of the App
  • Incomplete, incorrect, partial, or failed exports or incremental updates
  • File corruption, truncation, metadata loss, or format conversion issues
  • Incorrect change detection, duplicate handling, or fingerprinting
  • Interactions between the App and Apple Photos, macOS, iCloud, external storage, network drives, or third-party software
  • Hardware failure, disk errors, power loss, user error, or accidental deletion
  • Operating system updates, Apple Photos library format changes, or changes in third-party services
  • Any other cause, whether foreseeable or not

You are solely responsible for maintaining independent, verified backups of your photo library and any exported files. You should never rely on Photos Backup Pro as your only copy of any photo or video. Before and after each export, you are responsible for verifying that your data is intact and accessible.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Appify, its owner, employees, contractors, or affiliates be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of photos, loss of profits, loss of goodwill, cost of substitute services, or business interruption, arising out of or related to your use of, or inability to use, the App — even if we have been advised of the possibility of such damages and even if a limited remedy is found to have failed of its essential purpose.

Our total aggregate liability for any and all claims arising out of or related to the App or these Terms, regardless of the form of action, shall not exceed the amount you actually paid us for the App in the twelve (12) months preceding the claim, or 100 EUR, whichever is lower.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the smallest extent permitted by law. Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited, including, where applicable, mandatory consumer rights.

11. Indemnification

You agree to indemnify, defend, and hold harmless Appify from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the App or your violation of these Terms or any applicable law.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, or third-party service provider outages.

13. Termination

We may suspend or terminate your license to use the App at any time, with or without cause and with or without notice, if we believe you have violated these Terms. Upon termination, your license to use the App is immediately revoked.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
